The main duties for this role include :- Provide technical advice through the preparation of reports and briefings on building safety, building regulations, dangerous structures and land charges regulatory issues. Contribute to Council responses to government consultations and technical reviews in relation to building safety, building regulations, dangerous and temporary structures and land charges regulatory issues.
Provide support to the Building Safety Regulator under Section 13 of the Building Safety Act 2022 in the regulation of Higher-risk buildings and enforcement of the building regulations. Ensure full cost recovery for the Council in support of the Building Safety Regulator as set out in the Building Safety (Fees and Charges) Regulations (2023). Ensure that 'restricted activities' are only undertaken by the Building Control Authority upon the advice of a registered building inspector with the appropriate class registration for the building type. Ensure that the Council's building inspectors meet the requirements of the Building Safety Regulator in relation to competency assessment, training and development.
Enforce the building regulations within the Borough using powers under the Building Safety Act 2022 and Building Act 1984 to ensure public safety. Investigate offences under Section 57 of the Building Act 1984, prosecuting cases as required. Investigate unauthorised building work in the Borough resolving contraventions. Serve Stop and Contravention Notices for breaches of the building regulations, prosecuting cases as required. Serve notices under Section 36 of the Building Act 1984, carrying out the removal or alteration of offending work as required. Reject unlawful Initial Notices, Amendment Notices and Final Certificates. Enforce building control prohibitions on 'applicable persons' under the Building Safety (Responsible Actors Scheme and Prohibitions) Regulations 2023. Ensure the Council's dangerous structure engineers receive training and development and are up to date on structural safety matters. Contribute to emergency contingency plans and exercises in relation to dangerous structures. Ensure demolitions and temporary structures are inspected in the Borough and relevant notices and licences issued.
Review fire safety information submitted with planning applications on behalf of the Local Planning Authority and advise on compliance with relevant fire safety planning policy. Appoint third surveyors as set out in the Party Wall etc Act 1996, ensuring that best practice is being followed such as published by the Pyramus & Thisbe Society. Deputise where necessary for the Head of Building Control in the attendance of meetings and responding to correspondence. Contribute to reports and policy development on behalf of the Planning and Place Department. Ensure relevant corporate requirements regarding Health and Safety are met by the Building Control Authority. Ensure that General Data Protection Regulations are being met by the department. Ensure relevant Freedom of Information and Environmental Information Regulations are responded to.
